1. Introduction

Welcome to Flowsynk. These Terms of Service ("Terms") govern your access to and use of the Flowsynk website, mobile application, and services (collectively, the "Service"), so please read them carefully.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Definitions

  • "Flowsynk" (or "we," "our," or "us") refers to Flowsynk, Inc., the company that provides the Service.
  • "Service" refers to the Flowsynk website, mobile application, and all services provided by Flowsynk.
  • "User" (or "you" or "your") refers to the individual or entity that accesses or uses the Service.
  • "Content" refers to any text, images, videos, audio, or other material that is posted, uploaded, or otherwise made available through the Service.
  • "User Content" refers to Content that Users provide to be made available through the Service.

3. Account Registration and Requirements

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

4. Subscription and Payments

Flowsynk offers both free and paid subscription plans. By selecting a paid subscription, you agree to pay the subscription fees indicated for that service.

Subscription fees are billed in advance on a monthly or annual basis, depending on the subscription plan you select. Unless otherwise stated, subscriptions automatically renew at the end of each billing period.

You can cancel your subscription at any time through your account settings. If you cancel, you will continue to have access to the paid features until the end of your current billing period, but you will not receive a refund for any fees already paid.

We reserve the right to change our subscription fees at any time. If we change our fees, we will provide notice of the change on the website or by email, at least 30 days before the change takes effect.

5. Social Media Connections and Automations

The Service allows you to connect your social media accounts and set up automated responses and content. By connecting your social media accounts, you authorize us to access and interact with those accounts on your behalf.

You are solely responsible for:

  • Ensuring that your use of the Service complies with the terms and policies of the social media platforms you connect
  • The content of your automated responses and posts
  • Reviewing and approving AI-generated content before it is published
  • Any consequences that may arise from your automated interactions

We reserve the right to disconnect your social media accounts or disable your automations if we determine, in our sole discretion, that your use violates these Terms, the terms of the social media platforms, or applicable laws.

6. AI-Generated Content

The Service uses artificial intelligence to generate content based on your inputs and preferences. You acknowledge and agree that:

  • AI-generated content is created algorithmically and may not always be accurate, appropriate, or aligned with your intentions
  • You are responsible for reviewing and approving all AI-generated content before publishing it
  • We do not guarantee the quality, accuracy, or appropriateness of AI-generated content
  • You retain responsibility for all content posted through your accounts, whether created by you or generated by our AI

7. User Content and License

You retain ownership of any intellectual property rights that you hold in the User Content you post to the Service. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you post
  • The posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity

8. Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Harass, abuse, or harm another person
  • Send spam or other unsolicited messages
  • Interfere with the proper functioning of the Service
  • Attempt to access areas of the Service that you are not authorized to access
  • Use the Service to generate or distribute content that is illegal, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
  • Use the Service to generate or distribute content that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service

9. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Flowsynk and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Flowsynk.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.

11. Limitation of Liability

In no event shall Flowsynk, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • The use or performance of AI-generated content
  • Actions taken by social media platforms in response to automated activities

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Flowsynk does not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements
  • The AI-generated content will be accurate, appropriate, or effective for your purposes

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
